Crucially, costs for these services can be recovered as profit costs under established legal precedent. In Ahmed v Aventis Pharma [2009], it was held that sorting and chronology are tasks akin to fee-earning work typically carried out by solicitors. As such, they qualify for recovery at an hourly rate corresponding to Grade D (and potentially Grade C for chronology).
Beyond profit costs, these expenses can also be recovered as disbursements. This flexibility means they are often covered by disbursement funding schemes or After-the-Event (ATE) insurance. By outsourcing medical record collation and chronology to MRC, solicitors streamline case management while ensuring costs are recoverable.

Deferred Payment Terms
For ARAG-insured cases, fees are deferred until the case concludes. This arrangement frees solicitor firms to focus on securing the best outcomes without the financial burden of upfront payments.
Added Protection
If a case is lost or abandoned, MRC applies a fixed charge based on the volume of records, and our fees are always recoverable from ARAG at this rate. This financial safeguard offers peace of mind in challenging situations.
